Welcome to Found. These Terms of Use ("Terms") govern your access to and use of the website, services, and platform operated by Found Projects & Realty Limited ("Found", "we", "us", or "our"). By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

1. About Found

Found is an online marketplace that connects property seekers with realtors, agents, and property owners across Nigeria. We provide a platform for listing, discovering, and inquiring about properties including shortlets, land, buildings, shops, and business complexes. Found is not a party to any agreement, sale, lease, or rental concluded between users.

2. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use Found. By using the platform you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

3. Accounts and Registration

Certain features require you to register for an account as a realtor, agent, or other user. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that breach these Terms.

4. Property Listings

Realtors and agents are solely responsible for the accuracy, legality, and content of the listings they post, including descriptions, pricing, images, and availability. Found does not guarantee that any listing is accurate, current, lawful, or that the lister has the right to offer the property. Listings may be reviewed and must be approved before becoming publicly visible, but approval is not an endorsement or verification of the property.

5. Transactions and Your Safety

Transact safely with Found. Any transaction you conduct directly with a realtor, agent, or property owner is done entirely at your own risk. To protect yourself, run your transaction through Found — where we facilitate the deal so that both parties are secured. Found is not responsible for any loss, damage, fraud, or dispute arising from transactions conducted outside of our facilitated process.

You agree to exercise due diligence before committing funds, including verifying ownership documents, inspecting properties, and confirming the identity of the other party. Never send money to anyone you have not verified.

6. Fees and Commissions

Where Found facilitates a transaction or listing, applicable fees and commissions will be disclosed to you in advance. Agency and service fees are capped in line with our published policy. You are responsible for any taxes that apply to your transactions.

7. Prohibited Conduct

You agree not to:

  • Post false, misleading, fraudulent, or unlawful listings or content;
  • Impersonate any person or misrepresent your affiliation with any person or entity;
  • Use the platform to harass, defraud, or harm other users;
  • Circumvent, disable, or interfere with security-related features of the platform;
  • Scrape, copy, or harvest data from the platform without our written permission;
  • Upload viruses, malware, or any harmful code.

8. Intellectual Property

All content on the platform that is provided by Found, including text, graphics, logos, and software, is owned by or licensed to Found and is protected by applicable intellectual property laws. You retain ownership of content you submit, but grant Found a non-exclusive, worldwide, royalty-free licence to host, display, and distribute that content for the purpose of operating and promoting the platform.

9. Disclaimers

The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Found does not warrant that the platform will be uninterrupted, secure, or error-free, or that listings or user information are accurate or reliable.

10. Limitation of Liability

To the maximum extent permitted by law, Found and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of (or inability to use) the platform or any transaction conducted through or outside it.

11. Indemnity

You agree to indemnify and hold Found harmless from any claims, damages, liabilities, and expenses arising out of your use of the platform, your content, or your breach of these Terms.

12. Termination

We may suspend or terminate your access to the platform at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.

14. Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted on this page. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
